There is also a commercial version of MathViews, MathXplorer and WaveXplorer (See order.txt for details). The version you have is limited to 16K array size. You are hereby licensed to use this software for evaluation purposes without any charge for a period of 90 DAYS. If you use this software after the 90 DAYS evaluation period, you will need to buy it. This is not a free program, but is being distributed under the Shareware concept. This allows you to evaluate the program to determine whether it is worth anything, and then buy it if you are going to use it. You must buy the program if you are going to use it. Grant of License. Should you choose to Install the Software on additional computers, or increase user access via a network server, you must first acquire a license for each additional user who will use the Software. If the Software is an upgrade from a previous version of a MathWizards product, you may not transfer the prior version to another user. 2. Run-time Library License. The Software covered by this Agreement may be provided with a set of M-files (Software "Toolboxes") which can be used in conjunction with user-end modules to build complex M-files. You may use and distribute M-files prepared by you, but not those provided in the Toolboxes provided by The MathWizards. 3. Copyright. The Software is owned by The MathWizards or its suppliers and is protected by United States copyright laws and international treaty provisions. The MathWizards retains the rights to make and license the use of all copies. Therefore, you may make no copies of the Software or reproduce it in any way, except that you may (a) make a single hard-disk working copy of the Software and retain the original solely for back-up or archival purposes, (b) make a reasonable number of (additional) copies solely for back-up or archival purposes, or (c) make another copy or adaptation as provided by U.S. copyright law. You may not copy the written materials that accompany the Software. 4. Other Restrictions. You may not rent, lease, or otherwise transfer the Software, nor may you modify it, except as allowed by U.S. copyright law. 5. Term. This license is effective until terminated. You may terminate it at any time by destroying the Software and accompanying written materials, together with all copies thereof. It will also terminate if you fail to comply with any term or condition of this license. Upon such termination, you agree to return the Software and accompanying materials, including all copies thereof. This Agreement will automatically terminate without notice to you if you fail to comply with its terms. 6. Limited Warranty. The MathWizards warrants that the Software will perform substantially in accordance with the accompanying manual for a period of ninety (90) days from the date of receipt by you. . Defective media will be replaced without charge if returned during the warranty period. Software. This warranty is void if the Software is modified or if failure of the Software or other materials has resulted from accident, abuse, or misapplication. MathWizards makes no representation or warranty, express or implies, that the operation of the Software will be uninterrupted or error free, or that the functions contained in the Software will meet or satisfy your intended use or requirements; you assume complete responsibility for decisions made or actions taken based on information obtained using the Software. THE LIMITED WARRANTY IN THIS AGREEMENT IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING (WITHOUT LIMITATIONS) ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Any replacement Software will be warranted for the remainder of the original warranty period or thirty (30) days, whichever is longer. 8. Limitation of Liability. U.S. Government Restricted Rights. Software is provided with RESTRICTED RIGHTS. Use, duplication or disclosure by the Government is subject to restrictions as set forth in subdivision (c)(1)(ii) of DFARS, the Rights in Technical Data and Computer Software clause at 252.227-7013 (October 1988) and FAR 52.229-19(c) (June 1987), or comparable clause, such as may be amended or renumbered from time to time. This Agreement is governed by the laws of the State of California. 12. The waiver or failure of either party to exercise in any respect any right provided for in this Agreement shall not be deemed a waiver of any further or future right hereunder. 13. If any provision of this Agreement is found to be invalid or unenforceable, such finding shall not affect the validity or enforceability of any other provision herein.
